1. Acceptance of Terms
By accessing or using the 4Liquid platform and its associated services ("Service") on the Binance Smart Chain (BSC), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and the 4Liquid project. The Service is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein.
2. The Service
4Liquid is a decentralized, open-source perpetuals trading platform operating on BSC. The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue the Service at any time without notice. You agree that we are not liable to you or any third party for any modification, suspension, or discontinuance of the Service. The Service is a non-custodial platform. We do not have custody or control over your funds or your private keys at any time. You are solely responsible for managing your own funds and private keys.
3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the full right, power, and authority to enter into and comply with these Terms. You also represent that you are not a resident of any jurisdiction where access to or use of the Service is prohibited by law.
4. Risks
You acknowledge and agree that you are solely responsible for your own conduct while accessing or using the Service, and for any consequences thereof. You understand and agree that the Service is provided on a non-custodial basis, and we do not have control over your funds. Trading perpetual contracts and other cryptographic assets involves significant risk, including the potential for total loss of funds. You should carefully consider whether trading is appropriate for you in light of your financial condition and risk tolerance. You are responsible for complying with all applicable laws and regulations in your jurisdiction.
5. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. THE SMART CONTRACTS HAVE BEEN AUDITED, BUT WE CANNOT GUARANTEE THAT THEY ARE FREE OF BUGS OR VULNERABILITIES.
6. Limitation of Liability
IN NO EVENT SHALL 4LIQUID, ITS DEVELOPERS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT OF FEES YOU PAID TO US, IF ANY, IN THE 12 MONTHS PRIOR TO THE CLAIM.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the 4Liquid project is based, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within that jurisdiction for the resolution of any disputes.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
